1. Agreement to Terms

Welcome to Habi ("the App"), a habit tracking application developed by Téo Goulois ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Habi mobile application and related services.

By downloading, installing, or using Habi, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.


2. Description of Service

Habi is a personal habit tracking application that allows you to:

  • Create and manage daily, weekly, and custom habits
  • Track your progress and streaks
  • Attach notes, photos, videos, and audio to your habits
  • Receive reminders and notifications
  • Sync your data across devices via iCloud (optional)
  • Access premium features through subscription plans

3. Eligibility

The App is available to users of all ages. By using Habi, you represent that:

  • You have the legal capacity to enter into these Terms
  • If you are under 18, you have obtained parental or guardian consent
  • You will comply with these Terms and all applicable laws

4. Account and Sign-In

4.1 Sign in with Apple

You may optionally sign in using Apple ID to enable iCloud sync and backup features. When you sign in:

  • Your Apple ID credentials are managed by Apple
  • We receive only the information you choose to share (name, email)
  • You are responsible for maintaining the security of your Apple ID

4.2 No Account Required

You can use Habi without signing in. Your data will be stored locally on your device only.


5. User Content

5.1 Your Content

You retain all ownership rights to content you create in the App, including:

  • Habit names and configurations
  • Notes and journal entries
  • Photos, videos, and audio recordings
  • Personal goals and motivations

5.2 Content Responsibility

You are solely responsible for your content. You agree not to create content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains malicious code or harmful material

5.3 Content Storage

  • Your content is stored locally on your device
  • If you enable iCloud sync, your content is stored in your personal iCloud account
  • Media files (photos, videos, audio) remain on your device and are not uploaded to our servers

6. Acceptable Use

6.1 Permitted Use

Habi is licensed for personal, non-commercial use only. You may use the App to track your own habits and personal development.

6.2 Prohibited Activities

You agree NOT to:

  • Use the App for any commercial purpose without our written consent
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to the App or its systems
  • Use the App to develop competing products
  • Remove or alter any proprietary notices or labels
  • Use automated systems or bots to access the App
  • Share your premium subscription with others
  • Circumvent any technological measures designed to protect the App
  • Use the App in any way that could damage, disable, or impair the service

7. Subscriptions and Payments

7.1 Free and Premium Tiers

Habi offers both free and premium subscription plans:

  • Free Tier: Basic habit tracking with limited features
  • Premium: Full access to all features, including unlimited habits, advanced statistics, and priority support

7.2 Subscription Plans

Premium subscriptions are available as:

  • Monthly subscription
  • Yearly subscription
  • Lifetime purchase (one-time payment)

7.3 Payment Processing

All payments are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases.

7.4 Automatic Renewal

  • Monthly and yearly subscriptions automatically renew unless cancelled
  • You can cancel your subscription at any time through your Apple ID settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods

7.5 Price Changes

We reserve the right to change subscription prices. Price changes will:

  • Be communicated in advance
  • Not affect your current billing period
  • Require your acceptance for renewal at the new price

7.6 Refunds

All purchases are made through the Apple App Store. Refund requests must be submitted directly to Apple according to their refund policy. We do not process refunds directly.

To request a refund from Apple:

  1. Go to reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Select the purchase and request a refund

8. Free Trial

8.1 Trial Period

We may offer a free trial period for premium features. Trial terms:

  • Trial length and availability may vary
  • Only one free trial per Apple ID
  • You will be charged when the trial ends unless you cancel before the trial period expires

8.2 Trial Cancellation

To avoid being charged, cancel your subscription at least 24 hours before the trial ends through your Apple ID subscription settings.


9. Intellectual Property

9.1 Our Rights

Habi and its original content, features, and functionality are owned by Téo Goulois and are protected by international copyright, trademark, and other intellectual property laws.

This includes:

  • The Habi name and logo
  • App design and user interface
  • Source code and algorithms
  • Documentation and marketing materials

9.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

This license does not include the right to:

  • Modify or create derivative works
  • Use for commercial purposes
  • Sublicense or transfer to third parties
  • Use the Habi name or branding without permission

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.


11. Data and Backups

11.1 Your Responsibility

You are responsible for backing up your data. While we provide export and iCloud sync features, we are not responsible for data loss due to:

  • Device failure or loss
  • App uninstallation
  • iCloud account issues
  • Software bugs or errors

11.2 Data Export

You can export your data at any time through the App's settings. We recommend regular exports for important data.

11.3 Data Portability

Your exported data is provided in a portable JSON format that you can use as you see fit.


12. Disclaimers

12.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

12.2 No Guarantees

We do not guarantee that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Results from using the App will be accurate or reliable
  • Any errors will be corrected

12.3 Health Disclaimer

Habi is a habit tracking tool and is NOT intended to:

  • Provide medical, health, or psychological advice
  • Diagnose, treat, or cure any condition
  • Replace professional healthcare guidance

Always consult qualified professionals for health-related decisions.


13. Limitation of Liability

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TÉO GOULOIS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your data
  • Damages resulting from interruption or cessation of the service

13.2 Liability Cap

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.

13.3 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose.


14. Indemnification

You agree to indemnify, defend, and hold harmless Téo Goulois from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content created within the App

15. Modifications to the Service

15.1 Changes to Features

We reserve the right to:

  • Modify or discontinue features at any time
  • Update the App to fix bugs or add improvements
  • Change the availability of free vs. premium features

15.2 Notice of Changes

We will provide reasonable notice for significant changes that materially affect your use of the App.


16. Modifications to Terms

16.1 Updates

We may modify these Terms at any time. When we do:

  • We will update the "Last Updated" date
  • We will notify you of material changes through the App or by other means
  • Continued use after changes constitutes acceptance

16.2 Review

We encourage you to review these Terms periodically.


17. Termination

17.1 By You

You may stop using the App at any time by:

  • Uninstalling the App from your device
  • Cancelling any active subscriptions through Apple

17.2 By Us

We may suspend or terminate your access to the App:

  • For violation of these Terms
  • For conduct we reasonably believe is harmful to other users or us
  • For any reason with reasonable notice

17.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • You remain responsible for any outstanding charges
  • Provisions that should survive termination will remain in effect (including Sections 5.1, 9, 12, 13, 14, and 18)

18. Governing Law and Disputes

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

18.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved as follows:

  1. Informal Resolution: We encourage you to contact us first at teogoulois@proton.me to resolve any issues informally.
  2. Jurisdiction: If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of France.

18.3 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in class actions.


19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

19.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

19.5 No Agency

Nothing in these Terms creates any agency, partnership, or joint venture between you and us.

21. Apple-Specific Terms

As Habi is distributed through the Apple App Store, you also agree to the following:

  • These Terms are between you and Téo Goulois, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any claims related to the App
  • Apple is a third-party beneficiary of these Terms

By using Habi, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.


These Terms of Service are effective as of January 1, 2026.
